Quick answer

What is a fire NOC for a commercial building?

A fire NOC is the approval a state fire service issues confirming a building's fire prevention, life safety and fire protection measures meet state fire law and bye-laws. Malls usually need a plan-stage NOC, a final NOC or fire safety certificate before occupation, then periodic renewal or compliance filings set by their state.

This guide is for the operations heads, fire officers and centre heads who apply for or renew a mall's fire NOC in India. It covers which approval you need at each stage, the documents, and how to keep the certificate valid.

Fire safety is a state subject, so treat the Delhi, Maharashtra, Karnataka and Uttar Pradesh examples as illustrations and confirm with your local fire authority. The inspections themselves are covered in our fire safety checklist for malls.

What Is a Fire NOC?

NOC stands for no objection certificate, and the names vary: Delhi and Uttar Pradesh call the final approval a Fire Safety Certificate, while Maharashtra speaks of provisional and final fire approval. In everyday use, "fire NOC", "NOC from fire department" and "fire safety certificate" all refer to this chain of approvals.

Provisional NOC, final NOC and renewal

  • Plan-stage (provisional) NOC: before the building plan is sanctioned or construction starts. The fire service reviews drawings for fire tender access, exits, staircases, compartmentation, refuge areas, fire water storage and proposed systems, and issues a provisional NOC with conditions.
  • Final NOC or fire safety certificate: after construction, before occupation or the occupancy certificate. A site inspection checks installed systems against the approved drawings, test reports and the installing agency's certificates.
  • Renewal or periodic compliance: through the life of the building, at intervals set by the state. Depending on the state, the output is a renewed certificate, an annual declaration or a half-yearly maintenance certificate.

Which Commercial Buildings Need a Fire NOC

Each state sets its own thresholds in its fire services Act, rules or building bye-laws. The national reference is now the National Building Construction Standards 2026 (SP 7:2026, "NBCS 2026"), which replaced the National Building Code of India 2016 in April 2026. Its fire and life safety part (Part F) is for guidance and referral by state governments and local authorities, and many state rules still cite Part 4 of NBC 2016, which fire departments typically inspect against until they update.

A mall is usually a mixed occupancy (mercantile, assembly such as multiplexes and food courts, often business and car parking), and NBCS 2026 has specific provisions for this "mall-like" mix. In practice almost every mall falls within its state's thresholds:

StateLawBuildings relevant to mallsOngoing obligation
DelhiDelhi Fire Service Act, 2007 and Delhi Fire Service Rules, 2010, as amended by the Delhi Fire Service (Amendment) Rules, 2025 (Delhi Gazette, 26 May 2026)All assembly buildings; mercantile buildings above 9 m in height or with three or more storeys (mezzanine and stilt floors counted)Certificate valid unless suspended or cancelled, with an online Form K declaration every year
MaharashtraMaharashtra Fire Prevention and Life Safety Measures Act, 2006 and Rules, 2009Buildings covered by the Act and its schedules; confirm thresholds with the local Chief Fire OfficerMaintenance certificate in Form B from a licensed agency twice a year, in January and July
KarnatakaKarnataka Fire Force Act, 1964, section 13(3) inserted in 2023High-rise buildings (21 m or above, irrespective of occupancy)Confirm periodic requirements with the department
Uttar PradeshUttar Pradesh Fire and Emergency Services Act, 2022 and its RulesMulti-storeyed buildings above 15 m; "special buildings" including assembly and mercantile as defined in the National Building Code; mixed occupancies above 500 sq m covered areaMaintenance certificate twice a year, in January and July (section 26(5))

Elsewhere, check the state fire services Act and local development control regulations, then ask the Chief Fire Officer.

How to Apply for a Fire NOC Online

Most states take applications online, on the fire service portal or the state single-window system, which decides the forms and order.

  1. Confirm the category: plan-stage NOC, final NOC or renewal.
  2. Appoint the people: the fire consultant, licensed fire contractor or agency, and an internal owner who signs and tracks the file.
  3. Register on the portal with the correct occupancy, height, floor areas and number of basements.
  4. Upload drawings and documents from the checklist above, and pay the fee assessed.
  5. Prepare for inspection with a full pre-inspection walk using your fire safety checklist, and every test report on file.
  6. Host the inspection with the fire contractor present to demonstrate pump start, alarm activation and smoke control.
  7. Close observations within the time given, upload proof, and download the certificate. Record its date, conditions and next due date the same day.

State portals and who files

  • Delhi: under the 2025 amendment rules, the owner or occupier engages a Fire Safety Auditor from the list on the Delhi Fire Service portal. The auditor inspects, submits the inspection report (Form J) and declaration (Form I), and issues the Fire Safety Certificate (Form H) online, subject to verification by the Delhi Fire Service.
  • Maharashtra: applications go to the Directorate of Maharashtra Fire Services or the Chief Fire Officer of the local authority, and the half-yearly Form B is furnished to the Chief Fire Officer or nominated officer.
  • Uttar Pradesh: fire safety certificate applications are routed through the state's Nivesh Mitra single-window system to the Fire and Emergency Services department.
  • Karnataka: high-rise NOCs are issued by Karnataka State Fire and Emergency Services.

Fire NOC Validity and Renewal

There is no national validity period; each state decides whether the certificate expires or stays valid subject to periodic filings.

  • Delhi: under the amended rules (certificate provisions in force 90 days after the 26 May 2026 notification), the Fire Safety Certificate remains valid unless suspended or cancelled, provided Form K is filed online before each year is completed, counted from the certificate or the last Form K. The Tribune reported that the department will randomly inspect at least 5 percent of auditor-issued certificates every quarter.
  • Maharashtra: section 3(3) of the 2006 Act requires the owner or occupier to furnish a licensed agency's certificate twice a year, in January and July, confirming the measures are maintained in good repair and efficient condition (Form B under the Rules).
  • Uttar Pradesh: the 2022 Act requires a maintenance certificate twice a year, in January and July, and allows the certificate to be cancelled after a show-cause hearing if directions are not followed. Check validity and renewal steps in the current Rules and on the portal.
  • Karnataka and other states: confirm the renewal period with the fire department.

Fire NOC renewal lead times

Whatever the legal interval, a workable internal schedule is:

Fire NOC fees

Fees are set by each state, often by occupancy, height and built-up area. Delhi's amended rules notify ₹1,000 for the auditor's submission and for each annual Form K; Maharashtra assesses a fire service fee by occupancy type under its 2009 Rules. Elsewhere, check the portal.

Common Reasons a Fire NOC Is Rejected or Delayed

Most rejections are a gap between what was approved and what exists on site:

  • As-built differs from the approved plan: kiosks in exit paths, enclosed atrium edges, converted service areas.
  • Exits compromised: locked or blocked fire exits, stock in staircases, exit doors held open or wedged, missing exit signs.
  • Systems not on auto: pumps left in manual, valves closed, alarm panel showing faults or isolated zones.
  • Coverage gaps from fit-outs: new false ceilings without sprinkler drops, detectors covered or removed, partitions that break compartments.
  • Paperwork gaps: missing test reports, expired contractor licence, missed periodic certificate, no evacuation plan or drill records.
  • Change of use not declared: adding a multiplex, gaming zone or banquet space changes the occupancy and the fire requirements.

How Malls Keep the Fire NOC Valid

Malls that renew smoothly run these routines all year:

  • A fire systems AMC with clear scope, response times and monthly service reports, with the state's half-yearly or annual certificate built into the contract.
  • Scheduled inspections with proof, following your fire safety checklist and preventive maintenance checklist.
  • Mock drills that test the written fire evacuation plan, including tenant staff and the night shift.
  • Fit-out control through a mall work permit process that checks sprinkler and detector layout before work starts and before the store opens, with a hot work permit for welding, cutting and grinding.
  • A single compliance register with the fire NOC alongside lift licence renewals, electrical inspections and insurance, each with an owner and due date.

How LazyMonkey Compliance Tracks Fire NOC Renewals

LazyMonkey Compliance keeps the fire NOC, Form B or annual declaration, fire safety audits and every other licence in one register, each with an owner, a recurrence and the current certificate attached. Reminders go out at the lead times you set (say 60, 30 and 7 days before) by email, WhatsApp or mobile push, and every step is logged for auditors.

Conclusion

A fire NOC for a commercial building is a chain of approvals, not a one-time document. Know which state rules apply, keep the building matching its approved drawings, and start every renewal at least 90 days out with a named owner.

Frequently Asked Questions

Is a fire NOC mandatory for a shopping mall?

In practice, yes. State fire laws cover mercantile and assembly buildings above modest height or area thresholds, and Delhi's rules, for example, cover all assembly buildings and mercantile buildings above 9 m or with three or more storeys.

What is the validity of a fire NOC in Delhi?

Under the Delhi Fire Service (Amendment) Rules, 2025, notified on 26 May 2026, a Fire Safety Certificate remains valid unless suspended or cancelled, provided the owner, occupier, auditor or fire safety officer files an online declaration in Form K every year.

What is Form B in Maharashtra fire safety?

Form B is the certificate a licensed agency issues twice a year, in January and July, confirming that a building's fire prevention and life safety measures are maintained in good repair and efficient condition. The owner or occupier furnishes it to the Chief Fire Officer or nominated officer.

What is the difference between a fire NOC and a fire safety certificate?

"Fire NOC" is the common term for any fire department approval. The plan-stage NOC approves the design before construction, while the fire safety certificate or final NOC is issued after inspection of the installed systems, before the building is occupied.

How early should a mall start fire NOC renewal?

Start about 90 days before the due date: book the agency or auditor, test every system by day 60, close defects and file by day 30, and escalate anything still open a week before the deadline.
